professional users remain subject to these Terms and Conditions but do not benefit from all consumer-specific rights.\n<\/p>\n\n<p>The Application notably allows users to:<\/p>\n\n<ul>\n  <li>create and manage a wine cellar inventory (storage layouts, bottle records);<\/li>\n  <li>use a wine label recognition module based on a partnership with Vivino: the user takes a photo of the label, the image is transmitted to Vivino and VINOTAG displays the oenological information returned by Vivino;<\/li>\n  <li>access, optionally, a generative AI service (based on Gemini technology) providing advice on wines, cellar management, wine storage and food and wine pairings.<\/li>\n<\/ul>\n\n<p>\nAccess to all these services is exclusively via a mobile application downloadable from the App Store and Google Play, with contracts concluded remotely between FRIO and the Users.\n<\/p>\n\n<h2>1. PURPOSE<\/h2>\n\n<p>The Terms and Conditions aim to:<\/p>\n\n<ul>\n  <li>define the rights and obligations of FRIO and the user when using VINOTAG, purchasing Vivino scan packs, and subscribing to the AI service;<\/li>\n  <li>inform the user of their consumer rights: pre-contractual information, right of withdrawal, legal guarantees, mediation, and liability.<\/li>\n<\/ul>\n\n<p>\nAll information relating to the processing of personal data is set out in the personal data protection policy, which forms an integral part of these Terms and Conditions.\n<\/p>\n\n<h2>2. SCOPE OF APPLICATION<\/h2>\n\n<h3>2.1 Application of the Terms<\/h3>\n<p>\nThese general terms and conditions of sale and use (the \u201cTerms\u201d) apply to contracts concluded remotely between FRIO and any User and define the rights and obligations of the parties in relation to the provision of digital services and content via VINOTAG, within the meaning of Articles L. 224-25-1 et seq. of the French Consumer Code.\n<\/p>\n\n<h3>2.2 Services concerned<\/h3>\n<p>The Terms apply to:<\/p>\n<ul>\n  <li>free use of VINOTAG;<\/li>\n  <li>purchase of Vivino Scan Packs;<\/li>\n  <li>subscription to the optional AI Service.<\/li>\n<\/ul>\n\n<h3>2.3 Users<\/h3>\n<p>\nThese Terms apply to individual users of legal age acting as consumers for personal and\/or professional purposes.\n<\/p>\n\n<h3>2.4 Acceptance<\/h3>\n<p>\nRegistration on VINOTAG and\/or any purchase or subscription implies full acceptance of these Terms.\n<\/p>\n\n<h2>3. DESCRIPTION OF SERVICES<\/h2>\n\n<h3>3.1 VINOTAG \u2013 Core Service<\/h3>\n\n<p>VINOTAG notably allows users to:<\/p>\n<ul>\n  <li>create a user account linked to one or more eligible FRIO wine cellars;<\/li>\n  <li>manage bottle inventory;<\/li>\n  <li>consult wine information;<\/li>\n  <li>use the application manually;<\/li>\n  <li>receive storage recommendations;<\/li>\n  <li>remotely control certain connected wine cellar features.<\/li>\n<\/ul>\n\n<p><strong>Compatibility \/ interoperability:<\/strong><\/p>\n<p>\nVINOTAG requires a compatible mobile device, an active internet connection, and updated software.\n<\/p>\n\n<p>\nSome features may depend on connection quality, device performance, lighting, and image quality.\n<\/p>\n\n<p>\nFRIO does not guarantee compatibility with modified devices (root\/jailbreak), emulators, beta OS versions, or unsupported environments.\n<\/p>\n\n<h3>3.2 Vivino Module \u2013 Scan Packs<\/h3>\n\n<p>\nVINOTAG offers a wine label recognition module via Vivino.\n<\/p>\n\n<p>\nUsers receive a number of free scans depending on their cellar model and may purchase additional scan packs.\n<\/p>\n\n<p>\nA scan is consumed when the request is sent, even in case of failure.\n<\/p>\n\n<p>\nFRIO does not guarantee recognition or accuracy of Vivino data.\n<\/p>\n\n<h3>3.3 AI Service<\/h3>\n\n<p>\nVINOTAG offers an optional generative AI service (the \u201cAI Service\u201d) based on third-party technology (Gemini).\n<\/p>\n\n<p>\nThe AI Service provides informational assistance on wine selection, cellar management, storage, and pairings.\n<\/p>\n\n<p>\nThe AI Service:\n<\/p>\n<ul>\n  <li>is probabilistic;<\/li>\n  <li>may contain errors or outdated information;<\/li>\n  <li>does not constitute professional advice.<\/li>\n<\/ul>\n\n<p>\nThe user remains solely responsible for how they use AI-generated content.\n<\/p>\n\n<p>\nThe AI Service must not be used for illegal purposes or regulated advice.\n<\/p>\n\n<p>\nFRIO may apply usage limits to ensure service stability and security.\n<\/p>\n\n<h2>4. ACCESS CONDITIONS<\/h2>\n\n<h3>4.1 Age requirements<\/h3>\n<p>\nVINOTAG is strictly reserved for users aged 18 or over.\n<\/p>\n\n<p>\nUsers must comply with applicable alcohol regulations and responsible consumption practices.\n<\/p>\n\n<h3>4.2 Account creation<\/h3>\n<p>\nUsers must provide personal information (name, email, etc.) to create an account.\n<\/p>\n\n<h3>4.3 Security<\/h3>\n<p>\nUsers are responsible for their login credentials.\n<\/p>\n\n<h3>4.4 Suspension<\/h3>\n<p>\nFRIO may suspend access in case of fraud, misuse, or security risk.\n<\/p>\n\n<h3>4.5 Termination<\/h3>\n<p>\nFRIO may terminate the contract in case of serious breach.\n<\/p>\n\n<h2>5. PRE-CONTRACTUAL INFORMATION<\/h2>\n\n<p>\nFRIO provides all legally required information prior to contract conclusion.\n<\/p>\n\n<h2>6. PRICING AND PAYMENT<\/h2>\n\n<p>\nPrices are displayed including taxes. Payments are processed via Apple Pay or Google Pay.\n<\/p>\n\n<h2>7. SERVICE DELIVERY<\/h2>\n\n<p>\nServices are provided immediately after subscription or purchase.\n<\/p>\n\n<h2>8. RIGHT OF WITHDRAWAL<\/h2>\n\n<p>\nUsers have a 14-day withdrawal right unless waived for immediate digital service execution.\n<\/p>\n\n<h2>9. LEGAL GUARANTEES<\/h2>\n\n<p>\nServices benefit from legal guarantees of conformity and hidden defects.\n<\/p>\n\n<h2>10. LIABILITY<\/h2>\n\n<p>\nFRIO is liable for proper service delivery but not for indirect damages or third-party services.\n<\/p>\n\n<h2>11. MINOR PROTECTION<\/h2>\n\n<p>\nVINOTAG does not promote alcohol consumption.\n<\/p>\n\n<h2>12. PERSONAL DATA<\/h2>\n\n<p>\nData processing is detailed in the privacy policy.\n<\/p>\n\n<h2>13. CUSTOMER SUPPORT<\/h2>\n\n<p>\nSupport may include co-browsing with user consent.\n<\/p>\n\n<h2>14. INTELLECTUAL PROPERTY<\/h2>\n\n<p>\nVINOTAG content is protected by intellectual property law.\n<\/p>\n\n<h2>15. MEDIATION<\/h2>\n\n<p>\nUsers may contact ANM for dispute resolution.\n<\/p>\n\n<h2>16.
